Statement of a Group of Associations on Subjecting Detainees to Drug Tests

 After the horrible disaster that afflicted Lebanon, a number of  associations and institutions working in the field of prevention, treatment, psychiatry, rehabilitation and harm reduction send the families and friends of the victims of the Beirut massacre their warmest condolences and feelings of sympathy for their loss, and wish those injured and wounded a speedy recovery.

Following the civil movements and protests that took place in Beirut on August 8th and 9that Martyrs' Square and around the Parliament, Internal Security Forces (ISF) announced, in a statement, that a group of men and women were arrested and subjected to drug tests.   Therefore, the undersigned group of associations issued the following statement:

1.      Associations categorically reject illegal practices that contribute to further marginalization and stigmatization of young men and women, their families and their communities.

2.      Subjecting detainees to these tests is a violation of international conventions, human rights, principles of public health and the right to privacy, and a violation of public and personal freedoms.

3.      Subjecting detainees to these tests is a flagrant violation of the "Patient Rights and Informed Consent" law, mainly article 6, which states that "no medical work may be performed, nor any treatment may be applied without the prior consent of the concerned person."

4.      The decision to subject detainees to these tests, even if it comes directly from the Public Prosecutor, is without legal justification or suspicion of their drug use.

Therefore,

We call on the Lebanese judiciary and in particular the Public Prosecution, to:

·        Adhere to the universal declaration of human rights, which protects the right to life without compromising human dignity and violating rights;

·        Respect the Lebanese constitution, which guarantees the right of Lebanese citizens of freedom of expression;

·        Abide by the Lebanese law, especially article 6 of the “Patient Rights and Informed Consent” law.

·          Implement the Lebanese Drug Law No. 673/1998 which preserves the principle of "Treatment as an Alternative to Prosecution" in drug cases, especially since the “Inter-Ministerial Substance Use Response Strategy for Lebanon 2016-2021" stipulates in Article 1.3.2 that "Laws should be reviewed towards the decriminalization of drug use.

Finally, we believe that laws were made to protect and serve people and that law enforcement must reinforce this principle, not violate rights, increase marginalization and stigmatization. Hence, we reiterate our rejection of any measure or practice that violates human rights.

بيان مجموعة من الجمعيات حول إخضاع الموقوفين لفحوصات مخدرات

بعد هول الكارثة التي أصابت لبنان، تتقدم الجمعيات والمؤسّسات العاملة في مجال الوقاية والعلاج والتأهيل والحد من مخاطر استخدام المخدرات والطب النفسي من عائلات وأصدقاء ضحايا مجزرة بيروت بأحر التعازي ومشاعر المواساة لخسارتهم، وتتمنّى الشفاء العاجل للجرحى والمصابين. 

بعد التحركات والاحتجاجات الشعبية التي حصلت في بيروت بتاريخ 8 و9 آب في محيط ساحة الشهداء ومجلس النواب، والتوقيفات التي أعقبتهما وإعلان قوى الأمن الداخلي، في بيانٍ لها، إخضاع كافة الموقوفين إلى فحوصات مُخدرات، وهي ليست المرة الأولى، تداعت مجموعة من الجمعيات الموقعة أدناه وأصدرت البيان التالي:

أولاً، ترفض الجمعيات رفضًا قاطعًا الممارسات غير القانونية التي تُساهم في التهميش والوصم، عن غير حق، لمجموعات من الشباب والشابات وعائلاتهم ومجتمعاتهم.

ثانيًا، إن إخضاع الموقوفين لهذه الفحوصات هو انتهاك للمعاهدات الدولية ، لحقوق الإنسان ، لمبادىء الصّحة العامة والحق بالخصوصية وانتهاك للحريّات العامّة والشّخصيّة.

ثالثًا، إن إخضاع الموقوفين لهذه الفحوصات هو انتهاك فاضح لقانون "حقوق المرضى والموافقة المستنيرة" لا سيما المادة 6 منه والتي تنصّ على أنه "لا يجوز القيام بأي عمل طبي، ولا تطبيق أي علاج من دون موافقة الشخص المعني المسبقة".

رابعًا، إن قرار إخضاع الموقوفين لهذه الفحوصات، وإن جاء من النيابات العامة التمييزية مباشرةً، هو دون مسوّغ قانوني أو شبهة على استخدامهم للمخدرات.

 لذلك،

ندعو القضاء اللبناني، وبالأخص النيابة العامة التمييزية إلى:

-       الإلتزام بالمبادىء العالمية لحقوق الإنسان والتي تكرّس الحق في الحياة دون التعرّض للكرامة الإنسانية وانتهاك الحقوق؛

-       احترام الدستور اللبناني الذي يضمن حق المواطنين اللبنانيين في التعبير عن آرائهم؛

-  الإلتزام بالقانون اللبناني، خاصة المادة 6 من قانون حقوق المرضى والموافقة المستنير

-   تطبيق قانون المخدرات اللبناني رقم /1998 673 والذي يكرّس مبدأ "العلاج كبديل من العقاب" في قضايا المخدرات، خاصةً وأنّ "الاستراتيجة المشتركة بين الوزارات لمكافحة المخدرات والإدمان في لبنان 2016-2021" تنصّ في مادتها 1.3.2 على "مراجعـة القوانيـن بحيـث يتـم إلغـاء تجريـم اسـتخدام المـواد غيـر المشـروعة بمـا يتماشـى مـع المعاهـدات الدوليـة ومبـادئ الصحـة العامـة".

 أخيرًا، نحن نؤمن بأن القوانين وُضعت لحماية الإنسان وخدمته وأن على آليات إنفاذ القانون تكريس هذا المبدأ لا انتهاك الحقوق وزيادة التهميش والوصم. من هنا، نكرّر رفضنا لأي إجراء أو ممارسة تنتهك حقوق الإنسان.
